UK earned settlement rules: 3, 5, 10 and 20-year pathways to permanent residence explained

The UK Home Office published its revised “earned settlement” framework on 2 November 2026. It sets out how long migrants must wait before applying to settle permanently, and the wait now depends on earnings, job type and conduct. The rule changes are not in force yet, and they will be laid from December 2026 with implementation through 2027.

UK earned settlement: key points

  • 3 years: for exceptional economic contributors, with earnings of about £125,141 in 3 of the last 4 years, or those in the “Highest Talent Group” (not yet defined)
  • 5 years: higher earners (about £50,271 in 3 of the last 5 years), eligible public service workers such as doctors, nurses and teachers, and people with a “British connection”
  • 10 years: the default for others who meet the rules, with earnings of about £12,571 in 5 of the last 7 years
  • 20 years: for people whose immigration breaches or use of public funds rule out faster settlement

Requirements for all pathways

  • Good character: adult convictions or cautions, including overseas ones, can lead to refusal.
  • No outstanding government debt, including unpaid tax, National Insurance or NHS debt.
  • English at CEFR B2 level, up from B1, applying from 26 March 2027.
  • Life in the UK test passed.
  • Sustained contribution: normally earnings of at least £12,571 a year for the required period.

Children, people aged 65 and over, and people with a condition that prevents meeting a requirement are exempt from the English, Life in the UK and earnings tests. Couples can combine earnings to meet a household threshold of £25,142.

Which visas count towards settlement?

  • Count: longer-term work, talent, family and some protection routes.
  • Do not count: Visit, Student, Graduate, High Potential Individual, Global Business Mobility, Temporary Worker, Youth Mobility, Seasonal Worker and Overseas Domestic Worker visas, and Ukraine schemes.
  • Switching routes: moving between fundamentally different routes can restart the clock.
  • Long residence route: will close, with no date given yet.

People already in the UK

There is no general exemption, but some targeted arrangements exist. For example, care workers who arrived or switched before 12 May 2025 and meet the salary and employment conditions keep a 5-year period, and some skilled workers who arrived before 4 April 2024 can extend on current terms until 2035. Most others move to the new framework. Reports also say the Home Office estimates that more than 500,000 migrants would wait longer than five years under the changes.

What is still uncertain

  • How earnings will be assessed in practice and what counts as the “Highest Talent Group”, pending a Migration Advisory Committee report due by the end of December 2026.
  • The full list of qualifying immigration breaches and how overstaying will be treated.
  • Changes to fees and the Immigration Health Surcharge.
  • Rules for refugees and people who entered irregularly, which other reports describe as much longer qualifying periods; check the Home Office text for exact terms.

What it could mean for Indians in the UK

Many Indian professionals and students use UK work and study visas. Student and Graduate visa time does not count towards settlement, while skilled work routes do. Anyone affected should read the final Immigration Rules when published and get advice from a registered immigration adviser, as this page is general information only.

Frequently asked questions

When do the new UK settlement rules start?

Changes begin to be laid from December 2026 and will be implemented over 2027. Until then, existing rules apply.

How long will UK indefinite leave to remain take?

It depends on the pathway: 3, 5, 10 or 20 years under the framework.

Does a Student visa count towards settlement?

No. Student and Graduate visa periods do not count.

What English level is required?

CEFR B2, applying from 26 March 2027.

Questions to think about

  • Is linking settlement to earnings a fair way to reward contribution?
  • How should countries balance border control with the needs of hospitals, schools and care homes?
  • Should people already living and working in a country get more protection when rules change?
  • What help should migrants get to meet higher English requirements?
